Privacy charter
Bitwip considers data privacy to be one of the fundamental elements of business-to-business relationships. Our privacy policy and practices focus on processing, sharing and safeguarding personal data appropriately and in accordance with the legislation in force, while ensuring confidentiality, integrity and availability.
This privacy charter applies to the company Bitwip Conseil SAS (RCS Cayenne 827 688 011), whose registered office is at 1 place Schœlcher, 97300 Cayenne, and which is the controller of the processing it describes. Bitwip is at all times able to demonstrate that it complies with European Union (EU) legislation and with the principles set out herein. Some data is processed outside the EU, notably in the United States; section 06 explains which data and with what safeguards. This privacy charter defines the entire online privacy policy applicable to the activities of bitwip.fr. This charter sets out the type of information we collect about our online clients and how we use that information. Our website complies with the General Data Protection Regulation (the “GDPR”) (Regulation (EU) 2016/679), which is directly applicable. The GDPR establishes new rights for individuals and strengthens some of the rights that existed under Directive 95/46/EC. The GDPR replaced Directive 95/46/EC on May 25, 2018.
Personal data contact person: Vincent Reboul, Bitwip’s managing director, who can be reached at contact@bitwip.fr. He oversees the application of this charter and handles all questions about your data. Bitwip is the data controller within the meaning of the GDPR: the company determines the purposes and means of collecting and using the data.
Principles
Bitwip’s data protection policy is based on the following protection principles: Personal data will be processed in full compliance with the law and in a clear and transparent manner; personal data will be collected only for specified, explicit and legitimate purposes, and the data will not subsequently be processed in a manner incompatible with these principles; the collection of personal data must be adequate, relevant and limited to the information necessary for the purposes for which the data is processed; personal data must be accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that data that proves inaccurate with regard to the purposes for which it is processed is deleted or rectified without delay; personal data must be kept in a form that identifies the data subject only for as long as necessary for the purposes for which it is processed; all personal data must remain confidential and be stored in a manner that ensures appropriate security; personal data must not be shared with third parties, except where necessary to provide services previously agreed upon; data subjects must be able to request access to, rectification or deletion of their personal data, as well as restrictions on its processing, the ability to object to its processing, and their right to data portability.
Personal data
Personal data means any information that can be linked to an identified or identifiable natural person (the “data subject”). Personal data includes any type of information directly or indirectly attributable (that is, when combined with other data) to the data subject, such as name, date of birth, address, email address, phone number, etc.
Data collection
Website users who wish to use our services and who send us information may be asked to provide personal data so that Bitwip can manage and improve its business and services. Most of the time, we collect data such as name, address, email address and phone number. In the case of a job application, we may also collect the postal address of the candidate applying for a position.
We also collect personal data for statistical, administrative and communication purposes, for IT and security management, for physical security, as part of authentication and authorization systems, for support, for internal project collaboration, and for organizing teams and activities.
We will process personal data only to the extent required for specified, explicit and legitimate purposes or for purposes imposed by the legislation in force in the places where we operate. The data comes from what is entered by the person wishing to contact the Bitwip team, via the contact form of the “Contact us” button at the top of the page.
The contact form
The form on the Contact page asks for your first name, last name, email address, phone number, the name of your organization, your budget and a few lines about your project. The form for the one-hour consultation also asks where your organization is based; the Kazad demo form only asks for your name, email address, organization and message. Fields marked with an asterisk are required: without them, we cannot handle your request. Your needs and the news box are optional. The form also sends the page you are writing from and, if you arrive through a campaign link or an ad, the parameters of that campaign (utm, gclid). It does not set any cookies.
Business entered by our team
Bitwip’s team also uses this form, in an internal version, to record business received through another channel (phone, meeting, referral): the team enters your contact details and your request. Your client record and the quote are then created in Furious, our management tool, and the team is notified in Slack. To suggest the quote title, OpenAI, an artificial intelligence service, only receives the name of the organization, its sector, the type of project, the territory, the budget and the brief: neither your name nor your email address. Your contact details are only added to Brevo and to our Google Ads list if you have agreed to our news and targeted ads: the team then ticks the same box as on the site.
Why we use your data
- Responding to your contact, quote or demo request: these exchanges are pre-contractual steps taken at your request (Article 6(1)(b) GDPR).
- Following up your request commercially in our sales tool (HubSpot), recording business entered by our team (Furious) and knowing where requests come from (campaign parameters): our legitimate interest in keeping track of our exchanges with clients and prospects, and in knowing how well our campaigns perform (Article 6(1)(f)).
- Sending you our news: your consent, given by ticking the “Receive Bitwip news by email and through targeted ads” box, which is unticked by default (Article 6(1)(a)). See article 09.
- Showing you our ads on Google: if you ticked that same box, your first and last name, email address and phone number are added to a customer list (Customer Match) that Google matches against its user accounts. This list is based on your consent (Article 6(1)(a)): if the box is not ticked, your contact details are not added. You can withdraw this consent at any time, without giving a reason, by writing to contact@bitwip.fr: we will then remove your contact details from the list.
Retention period
- Request that led nowhere: three years from our last exchange, after which your data is deleted.
- Client: for the whole business relationship, then for the applicable legal retention periods, as provided in article 27.1 of our general terms and conditions of sale (ten years for accounting records, for example).
- News: until you unsubscribe. Your email address then stays on Brevo’s suppression list, only so that we no longer write to you.
Use of cookies
This site places no audience measurement or advertising cookie without your consent. Without a choice from you, or if you refuse, it only uses what it needs to work:
- the bitwip_consentement cookie, which keeps your choice for six months (see article 13);
- the langue cookie, placed only if you switch language at the bottom of the page, which remembers it for one year;
- in your browser, for the length of your visit, your landing page, the site that sent you here and the campaign parameters of your link (utm, gclid…): they only leave it if you write to us, with your form (see article 04);
- a few display preferences kept in your browser, such as the grid or list view of our work and news.
If you accept advertising, these campaign parameters are kept for 90 days in your browser, so that we know which campaign brought your request if you write to us later; they are deleted if you withdraw your consent. If you accept audience measurement, Google Analytics 4 places its own cookies; if you accept advertising, Google Ads and the Meta pixel place theirs. These tools then receive the pages you view on this site (see article 13).
You can also block cookies in your browser: the site remains usable.
You can also customize the cookies placed on this site by clicking .
Sharing of personal data
Personal data will not be shared with third parties, except where necessary to provide our services. We sometimes team up with other companies and partners to work on your behalf. We will not disclose any personal data to third parties for the purpose of advertising their products or services to our clients.
If users do not want us to share their personal data with these companies, they are asked to contact our personal data contact person at the following email address: contact@bitwip.fr
In certain situations, Bitwip may have to disclose personal information in response to a lawful request from supervisory authorities in order to meet the requirements of the GDPR. We may also disclose personal information where required by law, to comply with subpoenas or any other legal process, if we believe in good faith that such disclosure is necessary to enforce our rights, protect the safety of our clients or others, investigate fraud or respond to a government request.
The service providers that process your data
A request sent through our forms, or entered by our team, passes through the following service providers, which process it on Bitwip’s behalf and on its instructions:
- Vercel Inc., the site’s host, which receives the form and passes it on to Make;
- Make (Celonis), an automation tool, which routes the request to the tools below;
- HubSpot, our sales tool, which records the contact, organization and request sent through our forms;
- Slack, our internal messaging tool, which tells the team that the request has arrived;
- Brevo, our email tool, where your contact record and the name of your organization are only created if you ticked the news box, so that we can send you our news;
- Google (Google Ads), which only receives your first and last name, email address and phone number if you ticked the news box, for the audience list described in article 04;
- Furious, our management tool, which records the client record and the quote for business entered by our team;
- OpenAI, an artificial intelligence service, which only receives, for business entered by our team, the name of the organization, its sector, the type of project, the territory, the budget and the brief, to suggest the quote title.
Google Tag Manager, Google Analytics, Google Ads and the Meta pixel are only loaded if you accept them in the cookie window (see article 13): they then receive the pages you view on this site.
Transfers outside the European Union
Make, Brevo and Furious host Bitwip’s data in the European Union. Vercel, HubSpot, Slack, Google, Meta and OpenAI process it outside the European Union, in particular in the United States: the Vercel function that receives the form runs in the United States, and HubSpot and Slack store Bitwip’s data there. These transfers are covered by the standard contractual clauses adopted by the European Commission, included in these providers’ data processing agreements. You can obtain a copy of these safeguards by writing to contact@bitwip.fr.
Security of processing
We process personal data securely and apply and maintain appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, in particular where processing involves transmitting the data over a network, and against all other unlawful forms of processing. Questions about the security of personal data can be sent to our personal data contact person at the following email address: contact@bitwip.fr
Your rights
You can at any time ask to access, rectify or erase your personal data, restrict its use or obtain a copy in a common format (portability). You can also object to its use based on our legitimate interest, in particular to commercial follow-up, and withdraw your consent to our news and targeted ads at any time. To help us keep personal data up to date, we recommend that you tell us about any change or inaccuracy.
To access and/or modify their personal data, receive information about how long Bitwip intends to keep it, or for any request for information about the possible storage or processing of their personal data on behalf of a third party, users can send a request to the following email address: contact@bitwip.fr
We respond within one month. You can also lodge a complaint with the CNIL (see article 11).
Email marketing
We only send our marketing emails to people who have consented to them. This consent must be freely given, unambiguous and informed: it is given through a positive action.
On this site, this consent is given by ticking the “Receive Bitwip news by email and through targeted ads” box on our forms, which is unticked by default. The emails are sent with Brevo. This consent can be withdrawn at any time, through the “unsubscribe” link or by writing to contact@bitwip.fr, without affecting emails already sent.
When our team records your request (see article 04), you only receive our news if you have agreed to it: the team then ticks the same box.
Clients always retain the right to object, free of charge and on simple request, to the processing of their personal data for customer purposes in connection with direct marketing activities, without having to give a reason. To do so, simply click the “unsubscribe” link in emails received from Bitwip. Once a client has objected, their personal data will no longer be used for direct marketing purposes.
Marketing emails contain information we consider potentially of interest to our clients, such as the latest news about our products and services.
Accountability
Bitwip is accountable and will at all times be able to demonstrate its compliance with the GDPR and with the principles set out herein. Bitwip will keep records of the processing activities carried out under its responsibility, and these records must contain the information required by the GDPR.
To the extent that this provision applies, Bitwip must make the records available to the supervisory authority at its request. This charter is placed under the responsibility of our personal data contact person. Any request concerning it should be sent to him at the following email address: contact@bitwip.fr
Complaints
Clients may file a complaint about our processing of their personal data. All requests and complaints will be handled within an appropriate time frame and in accordance with internal procedures.
Anyone may also, at any time, lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL, the French data protection authority), Service des plaintes, 3 place de Fontenoy, 75007 Paris, or online at cnil.fr.
Changes to this charter
This charter may be updated from time to time, in particular due to changes in the relevant legislation in force or a change in the structure of the Bitwip group. Where applicable, clients will be informed by email or on the website before the changes take effect.
We recommend that all our users check this page regularly for the latest information about our privacy practices.
Cookie management
Two purposes require your consent: audience measurement, with Google Analytics 4, and advertising, with Google Ads and the Meta pixel. These tools are loaded only after you consent; without it, none of them places a cookie. If you withdraw your consent, their cookies are deleted.
Bitwip collects your consent with CookieConsent, an open-source tool hosted on this site. Your choice is kept for six months in a cookie from this site (bitwip_consentement), then you are asked again. You can change it at any time by clicking or “Cookie settings” at the bottom of every page.
